Other Responsible Persons
Packer’s Responsibilities:
- The packer shall comply with the legislation and rules regarding packaging and co-packing,
- If he prepares packages for transportation, he is obliged to comply with the legislation and rules concerning the marking and labeling of packages.
- It is obliged to comply with the requirements concerning the packaging conditions or mixed packaging conditions and the requirements concerning the marking and labeling of the packages when it prepares the packages for transportation.
Responsibilities of the Filler:
- Prior to filling, ensuring that the tanks and necessary equipment are technically complete and suitable for transportation,
- To check whether the test, inspection and control periods of vehicles, tanks and equipment used in the transportation of dangerous goods have expired,
- Filling in tanks that are suitable for hazardous substances to be filled and have a certificate of conformity in this regard,
- To act in accordance with the rules of loading together during filling,
- Not exceeding the maximum permitted filling rate and the maximum filling volume fraction (density) for the substance being filled,
- After filling, checking the tightness of the cover sections of the tank,
- To check that the filled hazardous substances do not contaminate the outer surface of the tank,
- When preparing dangerous goods for transportation, to ensure that orange warning signs, plates or labels are attached to tanks, vehicles, tank containers, large and small containers as well as dangerous goods packages in accordance with the rules,
- During the filling of the vehicles, it is obliged not to allow fire, open lighting and smoking in the immediate vicinity of the vehicles, not to keep objects with sparking properties and not to work with clothes with such properties.
Responsibilities of the Buyer
- Not to delay the acceptance of the cargo unless there is an obstacle to the delivery of the cargo,
- To ensure that the physical and chemical cleaning processes envisaged after the unloading of the vehicles and containers used are carried out in accordance with the provisions of ADR, that the hazard signs on the vehicle are removed after these processes and that measures are taken in accordance with the provisions of ADR if the services of other persons such as unloader, cleaner, detoxification processes are used,
- If it determines that the Regulation has been violated, not to deliver the container to the carrier until the violation is corrected, to ensure that security measures are fully taken in the unloading area and to check that the equipment used in the unloading process is working properly,
- Not allowing fire, open lighting and smoking in the immediate vicinity of the vehicles during loading and unloading of the vehicles, not allowing objects with sparking properties and not allowing to work with clothes with these properties,
- Comply with the provisions of ADR, including measures related to food, other consumer products and animal feed.
- In case of using containers, if it is determined that the ADR provisions are violated, not to deliver the container to the carrier until the violation is corrected,
- It is obliged to ensure that safety precautions are fully taken in the unloading area and to check that the equipment used in the unloading process is working properly.
Responsibilities of the Discharger:
In case any unfavorable situation is detected before unloading, to suspend the unloading process until the necessary measures are taken,
During unloading of tanks, vehicles and containers;
- 1) To ensure that the tank, vehicle or container is cleaned of hazardous residues contaminating the outside of the tank, vehicle or container during the unloading process,
- 2) Immediately ensure that valves and control gates are closed securely.
In the event that services are obtained from other third parties during the unloading of the package, tank, vehicle or container, it is obliged to check that measures in accordance with ADR requirements are taken by the persons performing this operation before, during and after unloading.
Responsibilities of the Administration:
- To compare the information on the packaging, container, tank, MEMU, MEGC or vehicle with the relevant information on the transportation document and to investigate and determine that the correct substances have been unloaded;
- Before and during unloading, to check whether the packages, tank, vehicle or container are damaged in a way to jeopardize the unloading process. In such a case, interrupt the unloading process until the necessary measures are taken;
- Comply with all unloading requirements;
- Immediately after emptying the tank, vehicle or container: (i) remove any hazardous residue adhered to the outside of the tank, vehicle or container during the emptying process; and (ii) ensure that the valves are closed and inspect any openings;
- Ensure that the requirements for cleaning and disinfecting vehicles and containers are fulfilled; and
- Removing the hazard signs from the container if the container is completely emptied, cleaned, decontaminated following the transportation of dangerous goods,
- While the unloading process is in progress, it is obliged not to allow fire, open lighting and smoking in the immediate vicinity of the vehicles, not to keep objects with sparking properties and not to work with clothes with these properties.
